Face Painting & Specialty Entertainment Services Addendum

These Face Painting & Specialty Entertainment Services Terms & Conditions (“Face Painting Terms”) are supplemental terms that apply whenever KWB Entertainment Inc. (“KWB”) provides face painting, temporary decorative artwork applied to the skin, face painting artists, or related specialty entertainment services (“Face Painting Services”).
These Face Painting Terms are an addendum to the applicable KWB Entertainment Inc. Event Services Agreement and do not replace KWB’s general Event Services Terms & Conditions.
Depending upon Client’s payment arrangement, the Event Agreement is also governed by one of the following:

These Face Painting Terms address matters unique to Face Painting Services. Except where these Face Painting Terms specifically modify a provision relating to Face Painting Services, all applicable provisions of the governing Event Services Terms & Conditions remain in full force and effect.
The specific Face Painting Services being provided, including service hours, number of artists, estimated guest participation, design options, specialty services, and other event-specific details, will be identified in the applicable Event Services Agreement, proposal, quote, or confirmation (“Event Agreement”).
Only services, artists, hours, materials, and enhancements specifically identified in the Event Agreement are included in the contracted price.
KWB will make reasonable efforts to use professional-quality, cosmetic-grade, water-based face painting products that are intended by their manufacturers for application to human skin.
Products will be used in a manner reasonably consistent with manufacturer instructions, labeling, and intended use.
Client understands that the terms “non-toxic,” “cosmetic-grade,” or “intended for skin” do not mean that a product is guaranteed to be free from every ingredient to which an individual may be sensitive or allergic.
KWB does not represent or guarantee that any face paint, cosmetic, glitter, adhesive, or related product is completely allergen-free or suitable for every individual.
Cosmetic products may cause irritation, sensitivity, or allergic reactions in some individuals even when the product is commonly used and intended for application to the skin.
KWB and its artists cannot know or reasonably determine every participant’s allergies, sensitivities, medical history, skin conditions, or prior reactions to cosmetics.
KWB does not perform medical evaluations, allergy testing, skin testing, or medical screening before providing Face Painting Services.
Participants, and parents or guardians of minor participants, are responsible for determining whether participation is appropriate based upon any known allergy, sensitivity, skin condition, prior reaction, or other individual concern.
A participant or parent/guardian with a known or suspected sensitivity to cosmetics, dyes, fragrances, preservatives, adhesives, glitter, or other cosmetic ingredients should decline Face Painting Services unless they have independently determined that participation is appropriate.
KWB is not responsible for an allergic reaction or sensitivity that KWB could not reasonably have known or prevented, except to the extent responsibility results from KWB’s own negligence, willful misconduct, or another circumstance for which liability cannot lawfully be limited.
When reasonably available, KWB may provide or display product packaging, manufacturer information, or ingredient information for face painting products upon request.
Participants and parents or guardians are responsible for reviewing available ingredient information when allergies or sensitivities are a concern.
KWB does not provide medical advice regarding whether a particular ingredient is appropriate for a specific participant.
Face Painting Services are frequently provided to children. Client understands that KWB artists may be working at an event where children approach the face painting area independently or as part of a group.
Client is responsible for determining and communicating any event-specific requirements concerning parental or guardian permission for minors to participate.
Unless a different procedure has been agreed to in writing before the event, KWB artists are not responsible for independently verifying the identity, custody, guardianship, or parental authority of each adult accompanying a child.
A parent, guardian, Client representative, or other responsible adult should supervise children as appropriate for their age and circumstances.
Client is responsible for informing parents and guardians of any participation rules or consent procedures established by Client or the venue.
At public, school, corporate, community, private, or similar events, children may approach a face painting station without a parent or guardian physically present.
Unless Client has notified KWB in advance that affirmative parental or guardian consent is required for each minor participant, KWB may reasonably rely upon Client’s event procedures and permit minors to participate in the same manner as other guests.
If Client requires written consent, wristbands, tickets, parental presence, age restrictions, or another authorization procedure, Client must communicate that requirement to KWB before services begin and is responsible for administering or assisting with the applicable procedure unless otherwise agreed.
KWB artists may decline to paint any individual when the artist reasonably determines that providing the service may be unsafe, inappropriate, or inconsistent with professional face painting practices.
Reasons may include, but are not limited to, visible cuts, open wounds, sores, significant skin irritation, visibly inflamed skin, active bleeding, obvious contagious conditions, inability to remain reasonably still, threatening behavior, or other circumstances that could create an unreasonable health or safety concern.
An artist may also decline a requested design or application location when the requested service would conflict with product instructions, safety considerations, event policies, or professional judgment.
Declining to paint an individual for a reasonable health, safety, behavioral, or operational concern does not constitute a failure to provide the contracted Face Painting Services.
Not every cosmetic color, glitter, adhesive, or other product is intended for use around the eyes, lips, mucous membranes, or other sensitive areas.
KWB artists may limit or modify a design when necessary to use products only in locations consistent with manufacturer instructions and reasonable safety practices.
KWB may decline requests to apply products to areas where the applicable product is not intended to be used.
KWB will use reasonable hygiene and sanitation practices appropriate to professional face painting services and the products being used.
Artists may clean, sanitize, replace, or discontinue use of brushes, sponges, water, applicators, products, or other materials as reasonably necessary during the event.
Participants must follow reasonable artist instructions intended to maintain sanitary working conditions.
Client understands that Face Painting Services take place in an event environment and are not performed in a sterile medical setting.
Available designs may vary depending upon the event, artist, age of participants, time available, guest volume, theme, materials, and complexity of requested artwork.
Photographs, samples, website images, design boards, or examples are intended to illustrate the general style of Face Painting Services and are not guarantees that every finished design will be identical to a sample.
Face painting is performed by hand, and reasonable artistic variations in color, size, placement, detail, symmetry, and appearance are normal.
KWB may refuse requests for artwork, words, symbols, imagery, or designs that KWB or the assigned artist reasonably determines to be unlawful, threatening, sexually explicit, hateful, discriminatory, harassing, dangerously inappropriate, or inconsistent with the nature of the event.
For school, youth, corporate, nonprofit, governmental, or family-oriented events, KWB may use additional discretion regarding designs considered inappropriate for the audience.
Face paint is temporary and is generally intended to be removed after use.
Participants should follow manufacturer recommendations or reasonable instructions regarding removal.
Unless otherwise directed by the product manufacturer, face paint can generally be removed using appropriate soap, water, cosmetic cleanser, or similar skin-cleaning products.
KWB does not guarantee that every color or cosmetic product will wash completely from skin, clothing, hair, towels, furniture, or other materials on the first cleaning.
Although reasonable care will be used, cosmetic face paint, glitter, water, cosmetic products, and related materials may stain or discolor clothing, upholstery, linens, carpet, furniture, or other property.
Client should provide an appropriate working area and take reasonable precautions to protect valuable, delicate, or stain-sensitive property near the face painting station.
Participants and parents or guardians are responsible for considering clothing and personal property when choosing to participate.
Client is responsible for maintaining reasonable control of Client’s employees, attendees, guests, invitees, and other event participants around the face painting area.
Guests may not threaten, harass, strike, push, touch without permission, or materially interfere with KWB artists or other participants.
Guests may not intentionally damage, contaminate, remove, steal, or misuse paints, brushes, chairs, tables, mirrors, signs, displays, supplies, equipment, or other materials.
KWB may refuse service to any individual whose behavior is threatening, abusive, destructive, materially disruptive, or unsafe.
Serious or continuing misconduct may result in temporary suspension or discontinuation of Face Painting Services as provided by the governing Event Services Terms.
Face Painting Services require participants to remain reasonably still while products are being applied near the face.
An artist may simplify a design, stop an application, or decline to continue when a child or other participant is unable or unwilling to remain sufficiently still for the service to be performed safely.
Parents, guardians, and Client representatives should not physically force or pressure an unwilling child to receive Face Painting Services.
Participation in Face Painting Services is voluntary.
KWB will not knowingly require a child or adult to receive face painting against that individual’s expressed wishes.
If a child indicates that they do not want to participate or asks for the application to stop, the artist may stop the service even if a parent, guardian, or another adult previously requested the face painting.
Face Painting Services begin and end according to the times stated in the Event Agreement.
The number of participants who can be painted during the contracted service period depends upon design complexity, number of artists, participant cooperation, guest volume, age of participants, requested detail, and other event conditions.
Unless a specific quantity is expressly guaranteed in the Event Agreement, KWB does not guarantee that a particular number of guests will receive face painting during the contracted service period.
KWB may limit design choices, offer simplified designs, establish a design menu, or otherwise adjust the service format when reasonably necessary to serve guests efficiently during periods of high demand.
Client understands that detailed full-face designs generally require more time than smaller or simplified designs and may reduce the number of participants who can be served.
KWB may close the face painting line before the contracted ending time when reasonably necessary to complete service for guests already waiting by the scheduled end of the event.
Closing the line to additional guests near the scheduled ending time does not constitute an early termination of services when the artist continues working through the contracted service period.
Client representatives should cooperate with reasonable line-closing procedures and announcements.
If guests remain in line at the contracted ending time, KWB is not automatically required to continue services beyond the scheduled period.
Additional Face Painting Services may be provided when artist availability, scheduling, venue requirements, and other circumstances permit and may be subject to overtime or additional service charges under the governing Event Services Terms.
Client must provide a reasonably safe, level, accessible, and adequately lit area for Face Painting Services.
The setup area should provide sufficient room for the artist, participants, supplies, seating, and reasonable guest flow.
KWB may adjust or decline a requested setup location when KWB reasonably determines that the location creates an unreasonable safety concern or is unsuitable for providing the contracted service.
The Event Agreement may identify whether tables, chairs, artist seating, guest seating, or other setup items are being provided by KWB or Client.
When Client is responsible for providing tables or chairs, they must be reasonably stable, clean, accessible, and suitable for the intended use.
For outdoor Face Painting Services, Client must provide an appropriate protected working area.
Face paints, cosmetic products, artists, and participants should be reasonably protected from rain, excessive wind, direct irrigation, blowing dust, extreme temperatures, intense direct sunlight, and other environmental conditions that could affect safety or the quality of the service.
A canopy, tent, pavilion, indoor backup location, or similar protection may be required depending upon weather and event conditions.
KWB may delay, relocate, modify, temporarily suspend, or discontinue Face Painting Services when weather or environmental conditions create an unreasonable risk to artists, participants, supplies, or equipment.
KWB may modify or suspend outdoor Face Painting Services during extreme heat when conditions create an unreasonable risk to artists or participants or materially impair the safe use or performance of the products.
Client should provide reasonable shade, ventilation, access to drinking water for contracted personnel, and other appropriate accommodations for outdoor events held during hot weather.
Face painting artists may receive reasonable breaks as required by law and as reasonably necessary based upon the length and conditions of the event.
KWB will make reasonable efforts to schedule breaks in a manner that minimizes disruption to the event when circumstances permit.
Unless a specific artist is expressly guaranteed in writing in the Event Agreement, Client is purchasing Face Painting Services from KWB rather than the personal services of a particular individual.
KWB may substitute a qualified artist when reasonably necessary because of illness, emergency, scheduling conflict, availability, or other circumstances.
KWB remains responsible for providing the contracted service notwithstanding an appropriate artist substitution.
Client, parents, guardians, and guests may photograph completed face painting artwork for ordinary personal or event-related purposes unless venue rules provide otherwise.
KWB will not rely upon this Face Painting Addendum alone as authorization to use identifiable photographs of children or other participants for unrelated advertising or promotional purposes where separate permission is required.
Any promotional photography rights, model releases, or permissions agreed to for a particular event may be addressed separately in the Event Agreement or another written authorization.
Paints, cosmetic products, brushes, mirrors, chairs, tables, displays, signs, containers, equipment, and other supplies provided by KWB remain the property of KWB or its applicable provider unless expressly stated otherwise.
Client is responsible for loss of or damage to KWB property caused by Client, Client’s employees, attendees, guests, contractors, or other persons under Client’s control, excluding ordinary wear and tear or damage caused by KWB personnel.
Reasonable repair or replacement charges may apply to intentionally damaged, destroyed, stolen, contaminated, or missing equipment and supplies.
When the Event Agreement includes specialty entertainment services in addition to or instead of face painting, the specific service, personnel, equipment, operating requirements, and limitations will be identified in the Event Agreement.
Provisions of these Face Painting Terms that reasonably relate to guest conduct, minors, event access, service hours, artist substitutions, outdoor conditions, equipment protection, and safe working conditions may also apply to specialty entertainment services when relevant.
Terms that specifically concern the application of cosmetic products to the skin apply only when the applicable service involves face painting, body painting, temporary cosmetic decoration, or a substantially similar service.
KWB artists are providing entertainment and cosmetic face painting services and are not providing medical treatment, diagnosis, dermatological services, allergy testing, or medical advice.
If a participant experiences discomfort, burning, significant itching, swelling, breathing difficulty, or another concerning reaction, the application should be stopped and the product removed as appropriate, and the participant or responsible adult should seek appropriate assistance based upon the circumstances.
These Face Painting & Specialty Entertainment Services Terms & Conditions supplement the applicable KWB Event Services Terms & Conditions.
If a provision of these Face Painting Terms conflicts with the governing Standard Event Services Terms & Conditions or Purchase Order Event Services Terms & Conditions, these Face Painting Terms will control only with respect to the Face Painting or Specialty Entertainment Service-specific subject addressed by the conflicting provision.
All other provisions of the applicable master Event Services Terms & Conditions remain in effect.
These Face Painting & Specialty Entertainment Services Terms & Conditions are incorporated by reference into any KWB Entertainment Inc. Event Services Agreement that includes applicable Face Painting or Specialty Entertainment Services and identifies or links to these Terms.
By signing or electronically accepting the applicable Event Agreement, Client acknowledges that Client has had the opportunity to review these Face Painting Terms together with the applicable KWB Event Services Terms & Conditions and agrees that both form part of the Event Agreement.
