These Photo Booth Services Terms & Conditions (“Photo Booth Terms”) are supplemental terms that apply whenever KWB Entertainment Inc. (“KWB”) provides photo booth services, digital photography, printed photographs, AI-generated images, GIFs, boomerangs, virtual backgrounds, physical backdrops, props, event galleries, image delivery, booth attendants, or related services (“Photo Booth Services”).

These Photo Booth Terms are an addendum to the applicable KWB Entertainment Inc. Event Services Agreement and do not replace KWB’s general Event Services Terms & Conditions.

Depending upon Client’s payment arrangement, the Event Agreement is also governed by one of the following:

These Photo Booth Terms address matters unique to Photo Booth Services. Except where these Photo Booth Terms specifically modify a provision relating to Photo Booth Services, all applicable provisions of the governing Event Services Terms & Conditions remain in full force and effect.


1. Photo Booth Services

The specific Photo Booth Services being provided will be identified in the applicable Event Services Agreement, proposal, quote, or confirmation (“Event Agreement”).

Depending upon the package selected, Photo Booth Services may include standard digital photographs, GIFs, boomerangs, AI-generated images, printed photographs, custom overlays, virtual backgrounds, physical backdrops, props, image sharing, an event gallery, or other features.

Only services, features, printing, staffing, equipment, hours, and enhancements specifically identified in the Event Agreement are included in the contracted price.

2. Photo Booth Attendant

When an attendant is included in the Event Agreement, KWB will provide personnel to set up, operate, monitor, and assist guests with the photo booth during the contracted service period.

The attendant may provide reasonable instructions regarding use of the equipment, props, printing, image sharing, guest flow, and other booth operations.

KWB may substitute a qualified attendant when reasonably necessary because of illness, emergency, scheduling, or other circumstances.

3. Standard Photos, GIFs and Boomerangs

When included in the selected package, guests may be able to create standard photographs, animated GIFs, boomerangs, or other digital image formats supported by the photo booth system.

Available features may vary depending upon the equipment, software, package, internet connection, event configuration, or other technical requirements.

KWB does not guarantee that every available photo booth feature will be selected or used by every guest.

4. AI-Generated Images

When AI-generated imagery is included in the Event Agreement, KWB may use artificial intelligence software or third-party technology to transform, enhance, stylize, or generate images based upon photographs taken during the event.

AI-generated images are created through automated technology and may occasionally contain unexpected, inaccurate, unusual, distorted, incomplete, or visually imperfect results.

KWB does not guarantee that an AI-generated image will perfectly reproduce a guest’s appearance, clothing, accessories, body proportions, facial features, background, requested theme, or other visual details.

Minor variations, artifacts, or unexpected creative results inherent to AI-generated imagery do not constitute a failure to provide the contracted Photo Booth Services.

KWB may refuse, restrict, regenerate, or delete AI-generated content that KWB reasonably determines may be inappropriate, unlawful, offensive, unsafe, or inconsistent with the nature of the event or KWB’s operating policies.

5. Printed Photographs

When printed photographs are included in the Event Agreement, KWB will make reasonable efforts to provide prints during the contracted service period using the print size, layout, or format identified in the Event Agreement.

Printed photographs may differ slightly in color, brightness, cropping, or appearance from images displayed on a screen because of printer characteristics, lighting, paper, software, or normal production variations.

Printing services are subject to normal equipment operation and availability of consumable supplies.

If a temporary printer malfunction occurs, KWB will make reasonable efforts to restore printing during the event. Digital Photo Booth Services may continue while a printer issue is being addressed when technically possible.

Unless specifically included in the Event Agreement, unlimited duplicate prints, post-event reprints, specialty paper, or additional print quantities are not included.

6. Digital Image Delivery

Depending upon the selected package and available technology, guests may be able to receive digital images through text message, email, AirDrop, QR code, download, or another supported method.

Digital delivery may depend upon internet access, cellular service, Wi-Fi availability, guest device settings, compatible devices, telephone carriers, email providers, third-party platforms, and other technology outside KWB’s direct control.

KWB does not guarantee immediate delivery of every digital image when delays or failures are caused by internet service, cellular carriers, email filtering, guest device settings, third-party services, or other circumstances outside KWB’s reasonable control.

A temporary inability to text, email, AirDrop, or otherwise transmit an image does not necessarily prevent the image from being captured or retained by the photo booth system.

7. Event Gallery

Upon request and when supported by the selected Photo Booth Services, KWB may provide Client with access to an online event gallery containing photographs or other digital images from the event.

When an event gallery is provided, KWB guarantees that the gallery will remain available for a minimum of ninety (90) days from the date the gallery is made available to Client.

KWB may maintain the event gallery for longer than ninety (90) days at its discretion; however, availability beyond the guaranteed ninety-day period is not promised unless expressly agreed to in writing.

After the guaranteed ninety-day period, KWB may remove the gallery, photographs, videos, GIFs, boomerangs, AI images, or other digital files without further notice.

Client is strongly encouraged to download and preserve any photographs or files Client wishes to retain permanently during the guaranteed gallery period.

8. Long-Term Storage and File Retention

Except for the guaranteed event gallery period described above, KWB does not guarantee permanent storage, backup, archival retention, or future recovery of event photographs or other digital files.

After applicable retention periods expire, files may be permanently deleted as part of KWB’s normal storage management practices.

Client is responsible for downloading and maintaining Client’s own long-term copies of photographs and digital content.

9. Gallery Links and Sharing

Client is responsible for determining with whom Client shares an event gallery link, downloadable photographs, or other digital content provided by KWB.

Once Client or an event guest downloads, forwards, posts, copies, shares, or otherwise distributes an image, KWB cannot control further use or distribution of that image.

KWB is not responsible for subsequent copying, posting, sharing, downloading, or distribution of photographs by Client, guests, or third parties.

10. Guest Consent and Participation

Client understands that Photo Booth Services involve photographing or recording voluntary participants.

Client is responsible for informing guests of the presence and nature of the photo booth when reasonably necessary and for obtaining any event-specific permissions, releases, parental permissions, or other consents required by Client’s organization, venue, or applicable law.

Guests who do not wish to be photographed should not participate in the photo booth.

11. Minors

When minors attend or participate in the event, Client is responsible for supervision of those minors and for determining whether parental or guardian permission is required for photography, digital delivery, event gallery access, or other use of the Photo Booth Services.

KWB personnel are not responsible for determining the parental or guardianship status of individual guests unless a specific procedure has been agreed to in writing before the event.

12. Inappropriate Photographs or Conduct

Client is responsible for the conduct of Client’s employees, attendees, guests, invitees, and other event participants while using the Photo Booth Services.

Guests may not intentionally use the photo booth to create content that is unlawful, threatening, abusive, obscene, sexually explicit, hateful, harassing, defamatory, dangerously inappropriate, or otherwise reasonably objectionable.

KWB reserves the right, in its reasonable discretion, to delete, remove, withhold, or prevent distribution of photographs or other content KWB determines to be inappropriate.

KWB will make reasonable efforts to identify and remove clearly inappropriate content once KWB becomes aware of it. However, KWB does not continuously review or pre-screen every photograph, GIF, boomerang, AI-generated image, or other item created during an event.

KWB is not responsible for inappropriate photographs, gestures, conduct, statements, poses, clothing, props, or other actions created or performed by Client’s guests or event attendees.

KWB’s inability to identify or remove inappropriate content before it is viewed, delivered, downloaded, or shared does not make KWB responsible for the conduct or content created by the applicable participant.

13. Guest Conduct and Safe Operation

Client is responsible for maintaining reasonable control of Client’s attendees and guests around the photo booth.

Guests may not climb on, strike, push, move, disconnect, intentionally misuse, tamper with, or damage photo booth equipment, printers, stands, lights, displays, backdrops, props, tables, or accessories.

KWB personnel may refuse Photo Booth Services to any individual whose behavior is threatening, abusive, destructive, materially disruptive, or unsafe.

Serious or continuing guest misconduct may result in temporary suspension or discontinuation of Photo Booth Services as provided by the governing Event Services Terms.

14. Props

When physical props are included, the props remain the property of KWB unless specifically stated otherwise.

Client is responsible for reasonable care of props while they are available to Client’s attendees and guests.

Client is responsible for props that are intentionally damaged, destroyed, removed, stolen, or missing as a result of actions by Client, Client’s employees, attendees, guests, contractors, or other persons under Client’s control.

Reasonable replacement charges may apply for missing or materially damaged props.

Normal wear and tear resulting from ordinary guest use will not be charged to Client.

15. Photo Booth Equipment Damage or Loss

The photo booth, camera equipment, computers, tablets, printers, lighting, stands, displays, backdrops, cables, accessories, and related equipment remain the property of KWB or its applicable equipment provider.

Client is responsible for loss of or damage to Photo Booth equipment caused by Client, Client’s employees, attendees, guests, contractors, or other persons under Client’s control, excluding ordinary wear and tear or damage caused by KWB personnel.

Reasonable repair or replacement charges may apply to damaged, destroyed, stolen, or missing equipment.

16. Setup Area

Client must provide an adequate, reasonably level, safe, and accessible location for the photo booth and any applicable backdrop, printer, props, attendant station, guest line, and related equipment.

KWB may adjust the placement of equipment when reasonably necessary for safety, lighting, electrical access, guest traffic, photography quality, equipment operation, or venue requirements.

KWB may decline to set up equipment in a location that KWB reasonably determines is unsafe, inaccessible, exposed to damaging conditions, or otherwise unsuitable.

17. Electrical Power

Client must provide suitable electrical power within a reasonable distance of the photo booth setup area unless alternative arrangements are identified in the Event Agreement.

The electrical circuit must be reasonably adequate for the photo booth equipment being used and should not be overloaded by other vendors or equipment.

KWB is not responsible for service interruptions caused by venue electrical failures, overloaded circuits, power outages, inaccessible outlets, or other electrical conditions outside KWB’s reasonable control.

18. Internet and Wi-Fi

Certain Photo Booth Services, including text delivery, email delivery, AI image generation, cloud processing, online galleries, or other digital features, may require reliable internet access.

When venue Wi-Fi or internet service is required, Client agrees to provide available network information or access credentials when reasonably necessary.

KWB does not guarantee the speed, availability, security, or reliability of internet or cellular service supplied by the venue, Client, telecommunications providers, or third parties.

When technically possible, KWB may continue providing available offline Photo Booth Services while internet-dependent features are temporarily unavailable.

19. Backdrops and Virtual Backgrounds

When a physical backdrop is included, Client must provide adequate space and a suitable location for installation.

Client and guests may not climb on, pull, lean against, relocate, or intentionally interfere with backdrop stands or support equipment.

Virtual backgrounds and automated background-removal technology may produce varying results depending upon lighting, clothing, movement, hair, reflective surfaces, crowding, and other photographic conditions.

Minor imperfections in automated background separation do not constitute a failure of the Photo Booth Services.

20. Custom Graphics, Logos and Overlays

When Client requests a custom start screen, photo overlay, logo, virtual background, graphic, or other branded element, Client represents that Client has the legal right to provide and authorize KWB to use the applicable artwork, trademarks, photographs, logos, text, or other materials.

Client is responsible for reviewing and approving custom graphics when approval is requested before the event.

Changes requested after approval or after production work has been completed may be subject to additional charges or may not be available if insufficient time remains before the event.

21. Photo Booth Service Hours

Photo Booth operating hours begin and end according to the times stated in the Event Agreement.

If Client’s program, dinner, presentation, entertainment, venue delay, guest arrival, or other activity causes photo booth use to begin later than scheduled, the contracted ending time does not automatically change.

An extension may be provided when staffing, scheduling, venue requirements, and equipment availability permit and may result in overtime charges under the governing Event Services Terms.

22. Guest Volume and Number of Photographs

KWB does not guarantee a specific number of photographs, sessions, GIFs, boomerangs, AI-generated images, prints, or participating guests unless a specific quantity is expressly guaranteed in the Event Agreement.

Actual usage depends upon guest participation, group size, session choices, print selections, AI processing time, guest interactions, line length, event schedule, and other factors.

Client is responsible for selecting sufficient contracted service time based upon anticipated attendance and desired guest participation.

23. Temporary Technical Interruptions

Photo Booth Services rely upon cameras, computers, printers, software, lighting, networking, electrical equipment, and other technology that may occasionally require restarting, adjustment, maintenance, replacement of supplies, or troubleshooting.

Minor or temporary interruptions that are promptly corrected are considered part of normal technical operation.

If a material equipment issue occurs, KWB will make reasonable efforts to repair, restart, substitute, or otherwise restore the affected Photo Booth Service.

KWB is not responsible for interruptions caused by venue power failures, internet outages, guest damage, venue restrictions, third-party platforms, telecommunications failures, or other circumstances outside KWB’s reasonable control.

24. Third-Party Software and Services

Certain Photo Booth Services may use third-party software, artificial intelligence services, cellular networks, cloud storage, email systems, text-message services, hosting platforms, or other technology providers.

KWB is not responsible for temporary outages, service interruptions, delays, policy changes, or failures caused solely by third-party providers outside KWB’s reasonable control.

KWB may substitute reasonably comparable technology or delivery methods when necessary to provide the contracted service.

25. Client and Guest Use of Photographs

Unless otherwise stated in the Event Agreement, Client and participating guests may download, save, print, share, and use photographs delivered to them for ordinary personal or organizational purposes associated with the event.

Client and guests remain responsible for how they subsequently publish, distribute, edit, caption, reproduce, or otherwise use photographs after receiving them.

26. KWB Use of Event Photographs

KWB will not rely upon this Photo Booth Addendum alone as authorization to use identifiable guest photographs for unrelated advertising or promotional purposes where separate permission is required.

Any specific promotional photography rights, releases, or permissions agreed to for an event may be addressed separately in the Event Agreement or another written authorization.

27. Conflict With Master Event Terms

These Photo Booth Services Terms & Conditions supplement the applicable KWB Event Services Terms & Conditions.

If a provision of these Photo Booth Terms conflicts with the governing Standard Event Services Terms & Conditions or Purchase Order Event Services Terms & Conditions, these Photo Booth Terms will control only with respect to the Photo Booth Service-specific subject addressed by the conflicting provision.

All other provisions of the applicable master Event Services Terms & Conditions remain in effect.

28. Acceptance of Photo Booth Terms

These Photo Booth Services Terms & Conditions are incorporated by reference into any KWB Entertainment Inc. Event Services Agreement that includes Photo Booth Services and identifies or links to these Photo Booth Terms.

By signing or electronically accepting the applicable Event Agreement, Client acknowledges that Client has had the opportunity to review these Photo Booth Terms together with the applicable KWB Event Services Terms & Conditions and agrees that both form part of the Event Agreement.
